Privacy policy

Policy presentation

Date of last update: 04/08/2022.
This Privacy Policy describes the methods we BG Trucks use in the various countries listed below for the collection, use, protection, and sharing of our customers' personal data. The term "customers" refers to individuals who visit our stores or businesses, place orders by telephone, fax, mail, or email, use our websites and mobile applications, or otherwise interact with us. Your personal data is processed on the basis of your consent (Art. 6(1)(a) of the General Regulation of the Protection of Personal Data (GDPR)), the necessity of performing a contract concluded with you (Art. 6(1)(b) of the GDPR), and our legitimate interests where these prevail (Art. 6(1)(f) of the GDPR). The controller of your personal data is indeed the entity BG Trucks located in the country where said data is collected.

Regarding the personal data we collect

We may collect personal data about you when you visit our businesses, shops, stores, etc., use our websites or mobile applications (the "Online Services"), or otherwise interact with us (these interactions are collectively referred to as the "Services"). The data we collect falls into three categories: (a) data you provide to us, (b) data we collect through automated means, and (c) data we collect from other sources. In principle, you provide us with your personal data voluntarily. However, in certain cases, the communication of such data is essential for the performance of a service or is required by the law. Please note that it is indeed impossible for us to provide you with certain services without this data. We will inform you when the provision of personal data concerning you is essential. We may combine the data you provide to us with data collected through automated means and from other sources.

Regarding the personal data you provide to us

Depending on how you interact with us, you may be required to provide us with the following data:
  • personal information (name, mailing and email addresses, phone number, date of birth, etc.) is collected when you register for our online services, connect to our Wi-Fi network, or contact us by telephone or through our online services
  • information about your transactions (purchased products, price, payment method, payment details, etc.)
  • information about the account you use to access our online services, purchase or use our products and services (username, password or other identifier)
  • information about your profile (products and services you like, preferred times to visit us, etc.)
  • and any other personal data that you agree to provide to us when you interact with us.

Regarding the personal data we collect through automated means

We use automated technologies to collect data from your computer or mobile device (phone or tablet) when you visit our website and use our online or in-store services. These automated technologies include cookies, local shared objects, and web beacons. We are therefore likely to collect the following data:
  • your IP (Internet Protocol) address
  • the dates and times you access our online services
  • the names and URLs of the files accessed using our online services
  • the type of operating system and browser used on the computer or mobile phone
  • the type of mobile device used and its settings
  • the Unique Device Identifier (UDID) or Mobile Equipment Identifier (MEID) associated with your mobile phone
  • the serial number of the device used and its components
  • the advertising identifiers (IDFA and IFAex) or other similar identifiers
  • the referring application or website (i.e., the site that led you to ours)
  • and your use of our online services (pages viewed on our websites or in our mobile applications, for example).
Our online services allow us to collect precise location information of your mobile device (phone or tablet) or computer using geolocation and technologies such as GPS, Wi-Fi, Bluetooth, and cell towers. For most mobile devices and computers, you will be asked to allow BG Trucks to process this information. You can revoke this permission by changing your device or browser settings. If you would like to know how to prevent us from collecting precise location information, we recommend contacting your mobile device provider, manufacturer, or browser provider. Some of our online services may not function correctly without your location information. If you would like us to delete the information we hold that allows us to locate you, please contact our Data Protection Office, whose contact details are provided below. We may be legally required to retain certain information.

Regarding the personal data we collect from other sources

We may collect data about you from other companies and entities, including public databases, social networks, and third-party partners such as analytics or marketing service providers. We may also collect publicly available information, such as from your profile, when you interact with us on social media. These platforms also allow us to collect communications addressed to us or concerning us. We may combine the data you provide to us with data collected through automated means and from other sources.

  • we use analytics and profiling technologies to personalize your experience, develop content (including ads) tailored to your interests and your use of our online or on-premises services, manage our business, diagnose potential technical or service-related problems, administer our online services, identify users of our online services, identify a device for fraud prevention purposes, gather demographic information about our customers, and determine usage patterns associated with our services.
  • to maintain, manage and improve our products, offers, promotions, online services and other technologies
  • ensuring the security of our networks and systems.

We must comply with the applicable legislation:

  • identifying, preventing and protecting ourselves against cases of fraud and all other offenses, claims and liabilities
  • to comply with our legal obligations and policies
  • establish, exercise or defend legal rights
  • and monitor and report non-compliance issues.
Provided you give us your consent (where required by the applicable law), we may use the personal data we collect for the following purposes:

We may use the information we collect about you in other ways. In such cases, we will inform you at the time of collection or ask for your permission.

Our methods of sharing collected personal data

We do not sell any of your personal data and only share it in accordance with the terms stipulated in this personal data protection policy. We may share your personal data within the "group," which includes: BG Trucks, our affiliates, subsidiaries, and franchisees. Group members to whom we transfer this data are not authorized to use or share it for any purpose or in any manner other than as described in this Privacy Policy. We may share your personal data with service providers who provide us with services such as: fulfilling orders, providing data processing and other information technology services, managing promotions, contests, raffles and lotteries, conducting studies and analyses, and offering a personalized experience to each BG Trucks customer. We prohibit them from using or sharing this information for any purpose other than providing services on our behalf. For strategic or other business reasons, we may decide to sell or transfer part or all of our business. In the context of such a sale or transfer, we may transfer the information we have collected and held (including personal data) to any person or entity involved in the transaction. We may be brought to share information that does not directly identify you, such as anonymous aggregated statistics about your use of our online services. We may also combine information about you with information about other customers and share it in such a way that it cannot be linked to any particular customer. We are entitled to use or share personal data as necessary to comply with any law, regulation or legal requirement, to protect our online and on-site services, to initiate legal proceedings or defend a legal right, to protect the rights, interests and safety of our organization, our employees, or the general public, or in connection with an investigation of fraud or any other breach or violation of our policies.

Home delivery

If, when ordering online, you choose home delivery as part of the delivery process, we will share some of your personal data (first name, last name, phone number, mailing address) with the chosen delivery company based on the weight and volume of your order, as well as with the delivery drivers for the purpose of delivering your order and issuing your invoice.

Children's Privacy Policy

We do not collect personal data from children under 15 years of age, unless it is necessary for a specific activity and the parent(s) or legal guardian has authorized us to do so. We recommend that parents regularly check and monitor their children's online activities.

Your choices

Marketing communications

If you have agreed to receive marketing communications from us, you can withdraw your consent at any time by following the instructions in those communications. You can also change your preferences in your phone's settings, or opt out of receiving these communications by contacting our data protection office, whose contact details are provided below. Even if you opt out of receiving marketing communications from us, we may still send you communications about your transactions, your accounts with us, and any games, contests, raffles, or lotteries you have entered. Opting out of one type of communication does not mean you will opt out of receiving other types of communication. For example, even if you opt out of receiving marketing emails, you will still receive marketing text messages (SMS). Unless you authorize us to do so, we do not share any personal data with third parties for their own direct marketing activities. We will share your personal data according to your instructions, subject to notification from us and your consent.

Data Controller

BG Trucks is responsible for processing your personal data.

The rights you have regarding your personal data

Regarding your personal data, you have the right to make the following requests:
  • When the processing of your personal data is based on your consent, you may withdraw it at any time, it being understood that such withdrawal will not affect the lawfulness of the processing previously carried out on the basis of your consent.
  • Access your personal data and receive a copy of it
  • Obtaining your personal data in a structured, commonly used and machine-readable format and asking us to transmit it directly to another company (provided that you have provided it to us yourself and its processing is based on your prior consent or on the necessity of performing a contract)
  • Have your personal data corrected if it is incorrect or incomplete
  • You have the right to object, on grounds relating to your particular situation, to our processing of your personal data based on our legitimate business interests (including profiling), as well as to the sending of marketing communications
  • Have your personal data erased, along with all links allowing access to it and any copies or reproductions thereof, to the extent permitted by the applicable law, for example, if your information is obsolete, unnecessary or unlawful, or if you withdraw your consent to the processing of this information by us, or if you manage to object to the processing of this information by us.
  • Have the processing restricted while we investigate a request or complaint from you regarding the accuracy of your personal data or the lawfulness of the processing of that data and our legitimate interests in that processing, or if you need that information in the context of a legal dispute
  • You may withdraw your consent to the processing of your personal data at any time.
You can exercise these rights free of charge, unless your request is unfounded or excessive, particularly due to its repetitive nature. If you wish to exercise your rights, please contact us by e-mail at: bruno.govin1@orange.fr Before we can provide you with information or correct any errors, we may need to ask you to confirm your identity and/or provide us with additional information to enable us to fulfill your request. In certain cases, and to the extent permitted by the applicable law, we may refuse to act or limit your rights. Before we can provide you with information or correct any errors, we may need to ask you to confirm your identity and/or provide us with additional information to enable us to fulfill your request. In any case, you have the right to lodge a complaint with the National Commission for Information Technology and Civil Liberties (CNIL).

Terms of use of our online services and other technologies

We and our service providers use cookies, web beacons and other similar technologies in connection with our online services and in other areas related to our business (such as online advertising) to collect information and provide you with the services or products you have requested.

Cookies and other technologies

A "cookie" is a small text file stored in a user's browser or device that allows the website to recognize the users and/or obtain information about them. A "web beacon" is a small object or image embedded in a web page, application, or email that tracks user activity. It is also referred to as a "pixel" or "tag". Please take note of the following:
  • A cookie may be sent to you when you use our online services.
  • Some of the features we offer require the use of cookies and other similar technologies.
  • The cookies and other tracking technologies we use can be either session tools (for the duration of your visit) or persistent tools (for a specific period of time).
  • Our online services and other areas related to our activities may be accompanied by web beacons.
We use cookies, web beacons, and other similar technologies to collect information for the purposes set out in this Privacy Policy. We may also combine information collected using these technologies with information about you that we have collected through other means described in this Privacy Policy. We may use these technologies for the following purposes:
  • to identify you, or your device, unambiguously
  • to allow you to access and use our online services smoothly (which would not necessarily be the case without them)
  • to strengthen the system security where appropriate
  • to statistically measure the use of our websites and mobile applications
  • improve our products and services
  • monitor the performance (traffic, errors, page load times, popular sections, etc.) of our online services
  • to recognize you when you access our online services, to facilitate your browsing
  • to personalize your experience
  • draw your attention through targeted advertising
  • the other purposes set out in the section of this privacy policy entitled “Our Terms of Use of Information Collected”.
For example, certain technologies allow us to determine if you have opened an email or clicked on a link contained in an email, and how you use the pages and content of our mobile applications. We may use these technologies to collect information about your online activities over time, whether you access third-party phones and websites or use our online services, in order to further personalize your customer experience. You can configure your browser to block cookies or to alert you each time you receive one. Simply click on your browser's "Help" section to learn how to change your preferences. If you disable all cookies, you may not be able to access all the features of a website. Some recent browsers have a "Do Not Track" option which sends a notification to the websites you visit indicating that you do not want your activity to be tracked. If videos are included in our online services, we may target and identify all the videos you watch. You authorize us to track your viewing activity across online services or third-party social networks for a maximum of two years, or as long as permitted by applicable law, or until you withdraw your consent.

Targeted advertising

When you use our online services, we (and our service providers) may collect information about your activities that allows us to offer you personalized advertisements. Considering that we work with multiple advertising networks, you may see ads on other websites. These networks allow us to target the information we send you based on your interests, other information about you, and contextual factors. These networks track your online activity over time by collecting information using cookies, web beacons, and web server logs. They use this information to show you ads that may be of interest to you. The networks we belong to collect information about the websites you visit (such as the pages or ads you view, or how you use those sites) if those sites are also part of the networks. We may use this information to provide you with personalized ads - both through our online services and on third-party websites belonging to advertising networks - and to evaluate the effectiveness of our marketing efforts. You can opt out of targeted advertising by writing to us at:
52 Rue Porte de Laon, BRUYÈRES ET MONTBERAULT
In this case, you will continue to receive ads, but they will not necessarily be tailored to your interests.

Links to other websites and social networks

Our online services may contain links to websites operated by third parties and not by us. If you visit one of these sites, we recommend that you review its privacy policy, terms and conditions, and other policies. We are not responsible for the policies and practices of third parties. The information you provide to them is processed in accordance with their own privacy policies, terms and conditions, and other policies. Our online services may also contain applications, tools, widgets, and plugins from other providers (such as the Facebook "Like" button). These providers may also use automated means to collect information about how you use these features. They process your information in accordance with their own policies.

Protection of personal data

We are committed to taking appropriate measures to protect your personal data. Our technical, organizational, and physical procedures are designed to protect personal data against accidental, unlawful, or unauthorized access, loss, disclosure, use, alteration, or destruction. Despite our efforts to protect our information systems, no website, mobile application, computer system, or information transmission over the internet or any other public network can be guaranteed to be completely secure.

Personal data retention

We retain your information for as long as necessary to fulfill the activities outlined in this policy and comply with our data retention rules (unless a longer retention period is required by law). These rules comply with the applicable laws. We will retain and use your data to the extent necessary to fulfill our legal obligations (such as the obligation to retain your information in accordance with the applicable tax laws), resolve disputes, enforce our agreements, and carry out any other activities described in this policy.

Personal data retention period

Your personal data will be retained for a period of three years from the date of your last activity (identification in store or on our digital tools, order, etc.) with BG Trucks, unless you object to the processing of your data or you exercise your right to be forgotten.

International transfers of personal data

Your personal data is not transferred outside the European Union. If we intend to transfer your personal data outside the European Union, we will inform you and take the necessary steps to ensure that your personal data receives an appropriate level of protection.
